Eu spouse visa directive 2004/38ec marriage history

hi
right i will try to explain situation

eu national female married to non eu currently both living together for last 3 years in non eu country .

they want to apply visa under directive 2004/38 ec to accompany spouse to ist ireland choice

if its hard then to schengen only visit visa to accompany eu spouse.

eu female arrived in non eu country 2009 and till now staying there with husband she got all visas for non eu country .

they got married back in 2006 . that time eu natioanl female use to visit husband and she gave birth to ist child in 2007 she went back to home country. child got eu passport.

she came back to her husband in 2007 in 2008 she fell pregnant again and went back to home country to give birth to second child and got second child eu passport as well

in dec 2009 she came back to non eu spouse and since then for the last 3 years they living together .

now if they apply ireland visa is eu natioanal nees to show her previous passport as well which she had in 2006 as she lost that passport and she got a another passport issued in 2009
someone told them they have to show old passport as well which is lost .


so if the passport is lost how she can show it is it realy necessary please help.

the question is is previous travel history to her husband country necessary when they got married thanks.

Hi johny_english,

you write a lot, but still important facts are not included:
  • what are the nationalities of the couple?
  • which countries do they really want to go to?
  • Do they want to travel for a visit or to move for good?
I´m pretty sure they >>won´t need a visa<<, but depending on the circumstances it might be better to get one.

the nationalities are
british female wife iranian non u husband

countries they want to visit is ireland

or any where in eu as bitish female lived 3 years in non eu country cant brring husband back to uk sponosorship problem

they will be applying visit visa after once in eu or ireland residence permit

in theory they dont need visa but in practice air line staff will never let the aboard

have you checked here

your wife and children can of course enter Ireland freely, and you are entitled to enter with them under Freedom of Movement.

Ireland isn't part of the Schengen area but does use a version of the Schengen visa application form for freedom of movement.

hi can someone tell please
in the case above how important is 2006 passport of eu national if they apply visa for her husband can embassy staff ask that and refuse visa on that if they dont have it thanks

As a summary: They want to move to the EU, not just visit? If so - where do they want to move to? Just to "anywhere"?

No - a passport does not matter. What matters is that the non-EU national is married to an EU-national. End-of-story. This fact alone allows them to move to the EU (in most cases, which could be established if you´d answer my questions).
