FLR (m) or Set (M)

Hi everyone,
I am hoping you can help me with the question below:
I am a tier 1 general dependant expiring in August 2012. My husband got his ILR this morning but I couldn't go with him (we had the appointment together) so I have to apply separately which I plan to do via post.

My question is, do I have to switch to FLR (M) first or can I apply directly for ILR on set (m)? I have been his dependant for Five years - WP + HSMP + T1. I want to send a postal application tomorrow.

If your husband was Tier 1 rather than HMSP, you will have to apply for FLR(M) first. There is no scope for the dependents of PBS migrants to apply for ILR separately while still on their PBS dependent status.

Thanks Lucapooka. My husbands visa prior to ILR was Tier 1 (from an HSMP extention). Can I apply for ILR right after the FLR(M) is granted as I have already been on a dependant visa for 5yrs or do I have to wait for a further 2yrs.
