Hello everyone,

I have a query regarding ILR and I would appreciate your help very much.

I am in UK since Oct 2007 (was on Work permit ). I got HSMP in Dec 2009 and then I was away from UK for one year - Jan 2010 to Dec 2010 and back in UK Since Jan 2011. Will I be eligible for PR in Oct 2012 as have more than 3 months gaps?

I would be grateful if anyone can help..Many thanks in advance.

Doesn`t seem likely but if you can prove that you were away for employment related reason..... not sure.
Need tyo ask a good Solicitor may be. :)

During your stay away from UK, if you had no connection with UK i.e. not paid any UK tax on your salary/Income etc., it is highly unlikely that your absence of one year away from UK will be counted towards your 5 year stay in UK for ILR purpose.
more likely that your ILR clock is reset and you will be eligible for ILR in Jan 2016.

Many Thanks!!! .. I was away from UK because my company called me back. I was working for the same company till Feb 2011. I didn't get any salary in UK and haven't paid any taxes in UK during that period..Will that count? Will this help?

unfortunately not.
