UK Tier 1 General Dependent Visa Refusal Appeal Guidance

UK Tier 1 General Dependent Visa Refusal Appeal Guidance

Hi,

I have Tier-1 General migrant visa in UK.
UKBA has refused visa for My spouse and 2 kids Tier-1 General migrant dependent visa from India.
Refusal Reason: Original Bank Statement missing
IFAT-2 form and Notice of Decision has been sent by UKBA.

My Main Query:

1) On IFAT-2 form, Section 3 - Appeal, Under D. - GROUNDS OF YOUR APPEAL, What reason should i mention ?

2) I have Tier-1 General migrant visa and my spouse and 2 kids are applying for Tier-1 General migrant dependent visa.
On IFAT-2 form, page 1. which type of decision should i TICK ?
Type of decision:
- Settlement
- Non Settlement
- Family Visit

3) Section 2.A Is your refusal a PBS decision - Shall i Tick Y/ N

4) Section 2.C Name of decision making post - Not given on Notice of decision. I have only got post reference number on it. Pl. advise.

5) Do I need to send any other documents or previously sent documents which visa office in India already have it ?

6) Do I need to send pre-paid special recorded delivery so that they can return the original docs later after the decision is made ?

After discussing with First-Tier Tribunal customer service, I have decided to opt for:
- Oral Hearing - cost £140 each person
- One sp. delivery envelope with all 3 appealants IFAT-2 forms and all documents listed below:-

Documents available to submit to First-Tier Tribunal - Leicester are:- IFAT-2 form downloaded from website for 3 appealants (Spouse and 2 kids)
- Nomination letter as I am representative and sponsor on behalf of appealants spouse and 2 kids
- Notice of decision - Have recvd. scancopy of all 3 appealants from India (reason for refusal: ORIGINAL BANK STATEMENT NOT SUBMITTED)
- Original 7 months Citibank Statements - Aug'11-Feb'12
- Original Citibank Reference Letter mentioning i have maintained £3600 for last 6 months in my account
- 1 Set of Photocopy of bank statements
- COVER LETTER

Please advise, if I am missing any other important documents.

1 - you need to advise the reasons for the visa refusal (it should have been explained in the letter from UKBA)
2 - Non settlement
3 - NO
4 - The letter you have received should be counter signed. Use that name. If no name, address this to UKBA
5 - You can not add any documents unless requested
6 - No, unless asked explicitly

The waiting time for appeal processing at leicester office is 4-5 weeks.

I feel to drop the plan of appeal.

The appeal can take as much as 6-8 months, so take that into account if you wish to appeal.

If you did not include original bank statements as evidence of maintenance funds at the time of the application, then what is the grounds of your appeal?

I have been refused my dependent Tier 1 visa to the UK and i have further processed an appeal
dated 16th february 2015.

i am waiting for the result and received letters stating i will get the update before July 2015 and then a
tribunal update date with 6th August 2015


Can anyone guide me with the exact timeline it takes for the result to be out..

i have been waiting for long.

Hi,

It is not very clear. What date did you have your FTT appeal hearing. If possible please explain the reason for refusal and your grounds of appeals as well.
