In UK since 10 Years - Illegaly

Post by jinder » Sat Mar 10, 2012 6:43 pm

Hi,

I landed in UK 10 years back through illegal means and has been staying here since.

- I have not claimed any benifits ,
- Did hot jobs for first 4 years
- Since last 6 years , self employed and paying tax,I am a builder,

I do understand I need to have a solicitor but thaught should first try here for advice.

Please can someone guide me on below
- Can I apply for citizenship?
- If yes then under what category my case comes ?
- What aspects I should prepare to make my case comperhensive ?

Please help!

Thanks,
Jinder

You can't apply for citizenship and under your current status you can only apply for ILR under long residence (but the category with no valid leave) when you have made 14 years, having avoided enforcement action that stops the clock, and until that time you are always liable for enforcement action. If you make 14 years and are granted ILR you will then have to wait a further five years to become eligible for citizenship.

Seek professional advice on the full scope of your options.

Even if it did, you would need ILR first....and unfortunately you don't qualify for that either.
