Tier 1 Dependant PR rule & Child born outside UK Guidanc

Post by kunal parikh » Sun Mar 11, 2012 1:11 pm

Hi

I am currently on Tier 1 General visa. My wife is on my Tier 1 dependant visa. My wife is pregnant and currently back home in India. My wife decided to stay back home due to health reason and so my child is now going to born in india. My extension is due in Apr 2013.(3 + 2 year)

I have couple of questions:

1) Will my child also get the dependant visa since he is going to born outside India? I believe applying visa outside UK for child will be same as applying for any immediate dependant. I believe my child will get PR at the same as I get my PR. I think child will get straight away British passport when he is born in UK.

2) Can my wife (dependant) is allowed to stay outside UK for more than 3 months for getting PR? Will she get the PR at the same time as me in 2015? She has joined me on October 2010 and stayed till Nov 2011. Since then she is in India ( 30 Nov 2011)

3) I am also eligible for the PR as per long residency rule in June 2013. I really think I should go my PR as per Tier 1 as I and my all dependant can get the PR at the same time in 2015.

I appreciate your reply and help.

Thanks
Kunal

I believe Dependents cannot qualifiy for ilr with main applicant on 10 year rule. They will have to apply in their own capacity.

Please search other threads before posting questions. ILR is granted to the main applicant and not the dependant. The dependant just tags along, hence no such restriction applies to the dependant.
