I have a Q regarding ILR application for people who entered this country using HSMP in 2006 and who are covered under ILR judicial review .
My case - I APPLIED for my HSMP on 25th Jan 2006 and RECEIVED approval letter on 3rd May 2006.
Got my Tier-1 extensions twice since then(couldn't apply for ILR earlier as was out of country for almost 1.5 yrs.) My continuously residence in the country is therefore valid from 10th Dec 2007, day when I returned back to UK and living here since then.
Now I want to apply for my ILR. My Qs
1) I am assuming I fall into HSMP judicial review since I first entered the country on my HSMP that I applied and received in 2006.
2) Will I be eligible to apply in 4 yrs since I APPLIED on 25th Jan 2006, since this date is before the cutoff date of 3rd Apr 2006 or I will be eligible for 5 yrs, since I RECEIVED my approval on 3rd May 2006, which falls after cutoff date of 3rd Apr 2006 ?
There is big confusion between date when you APPLY or date when you RECEIVE.
3) Will my wife, who joined me as my dependant in Jan 2012, be also eligible to apply for ILR along with me or she has to wait for 2 yrs continuous residency clause ?
Since I fall under ILR judicial review, will she also be eligible to apply now itself along with me ?
4) Do I need to give Llife in UK test ?
5) In SET(O) form, which category do I fall into -
- Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial Review Policy Document
or
- Highly skilled migrant under the terms of HSMP ILR judicial review policy document
These categories are mentioned in page 7 SECTION B of form SET(O).
Any help will be highly appreciated.
