Good afternoon all.

My wife is non EU, me EU
We arrived to Ireland in 2005.
She had 1 year, then 1 year, then 5 year resident stamp 4 EUFAM.
Current 5 year stamp is to expire in February 2013.
She had stamp 4 for entire period of nearly 7 years bar 9 months processing times.
According to INIS calculator she would qualify for Irish Citizenship.
Question.
Can she apply straight away for citizenship.?
Or first she has to apply for PR then citizenship.
She has been working 6 years out of 7, being on social for 10 months.

she can apply for irish citizenship now. she maybe lucky get her decsion within 6 months. www.inis.gov.ie citizenship section you will find the more information

There are separate applications, separate laws. One is Citizenship of Ireland (nothing to do with EU law), the other, PR, is Residency under EU law (Irish PR is not available for people already holding stamp 4 of some sort)

You can apply for both , I would not be so optimistic about the 6 month wait. It might / will be more. They are not reliant on each other.

So long as the EU citizen exercised their EU rights (Article 7) for a continuous period of 5 years (what the non EU person did is irrelevant) then the non eu person will get PR.

I do not see point applying for PR if she can apply for Irish Citizenship straight away.
And with luck she may get it within 6 months .

She was on socilal, lost a job, now she is back to full employment, been working 6 out of last 7 years.
Why would that matter if she was entitled to it while looking for a job ?

Hence PR might be relevant

For Irish Citizenship, you should not have claimed social for 3 years immediately prior to the application.

But, each case may have different circumstances

eg Length of legal time here vs length of time actually legally working

Length of time working v length of time out of work
