child OCI eligiblity

Post by blueygrey » Thu Mar 15, 2012 10:29 am

Hi,
Me and my husband both are british citizens (HSMP TO ILR TO BC)

We reside in London, so if our child is born here in London, obviously he will hold a british passport, but will he be eligible for OCI?

On the other hand, if the baby is born in India, then would he be?

Ive visited a few sites n they arent giving a clear answer.
Help!

As his parents are British the child will be British (otherwise than by descent) if born in the UK, and British (by descent) if born outside the UK.

whether he is entitled to OCI is a question for the Indian authorities. Or you could try the other countries section of the forum.

If one of the parents is eligible for OCI then the Child will be as well: Eligibility for minor applicants:one of the parents should be eligible for OCI
