Advise to sponsor mother

Post by sanju12 » Thu Mar 15, 2012 8:34 pm

I am on discreationary leave to remain granted under my Article 8.

My wife and son is British.

My DLR will expire in June 2013 ,need to extent is again for another 3 years to be eligible for ILR.

1. Can my wife be a sponsor of my mother( Widow ,68 years) for settlement visa?

2. My mother have 2 years family visit visa until August 2013. Is it possible that settlement visa can be applied in August 2012.

3.Can we make application in U.K when she will visit us.

If I change my status to a spouse of a British Citizen then:
1.Can I sponsor my mother as dependent.
2. Do I need to wait until I get ILR?

1. You would need to leave the UK and apply for entry clearance in that category but , assuming she actually meets the onerous requirements in the parent settlement category, you could not sponsor your mother for a further 2 years until you were granted ILR.
2. See 1.

No your wife's can't sponsor your mother.

You can only sponsor your mother after you have ILR, which, if you return home to apply for entry clearance as the spouse of a settled person, would be two years after you have entered the UK in that capacity.

However, I think you should discuss with a competent person the chances of your mother being granted settlement beforehand.
