Switching from Post Study Worker to Tier2

Hello,

What is the current salary requirement for switching to Tier2 General from post-study, is it £20,000 per annum?

Also what other restrictions that may apply to this (annual limit, shortage job, labour market test, etc.).

Try installing Internet download manager. Right click on the PDF link and download with "IDM"

I suggest dedicating this topic to all issues related to PSW-Tier2 switching.

New Question:

The old Tier2 policy guidance (until 05-Apr-2012) states that a PSW holder can switch to Tier2 General after working for the same employer for 6 months.

The new policy guidance (from 06-Apr-2012) does NOT have this condition mentioned.

Does this mean that someone can switch to Tier2 without needing to wait for 6 months?

These kind of discrepencies become really confusing.

A PSW holder can switch to TIER2 at any time. But,

IF the PSW holder works for the employer for the last 6 months he is exempted from Resident labour market test (RLMT)

If the PSW holder works for the employer for less than 6 months he is subject to RLMT (His employer of course)

Provide sources please? Maybe screenshots of the section in both guidance?

Old Tier2-general Policy Guidance (until 05-Apr-2012)

Switching from a post-study category

97. You will be awarded 30 points if you have a Certificate of Sponsorship and are switching from:
•Tier 1: Post Study category; or
•Fresh Talent: Working in Scotland Scheme; or
•International Graduate Scheme (or its predecessor, the Science and Engineering Graduate Scheme);

AND

•if you have worked for your sponsor for a continuous period of at least six months immediately before the date of your application. You must be applying to continue in the same job you are doing on the date of the application.

AND
•if you are applying from inside the United Kingdom

Post-Study Work

86. You will be awarded 30 points if you have a Certificate of Sponsorship and are are applying to switch into Tier 2 (General) and you have or had last been granted leave to enter or remain under one of the following:
• Tier 1: Post Study category; or
• Fresh Talent: Working in Scotland Scheme; or
• International Graduate Scheme (or its predecessor, the Science and Engineering Graduate Scheme).

Your sponsor will only be exempt from undertaking a resident labour market test if you have current leave in one of the above categories on the date of your application.

So one can see that the new policy guidance does NOT make any reference to working for 6 months.

Any ideas?

Does this mean that -according to the new policy guidance- one can switch as soon as he/she is assigned a CoS?

yes from 6th April those on psw will not need to work for the employer for 6 months to be exempt from the rlmt. This change is being made as tier 4 migrants switching to tier 2 will not have to work for the employer for 6 months either.
