ILR 2 year qualifying period for wife

ILR 2 year qualifying period for wife

Hi

I am due for applying ILR in a month time. I wonder whether I could include my wife and my son in my ILR form as dependants. As my wife spent 12 months in India for maternity reason.

By the time I make the application her total months of stay in UK will be 21 months.
Would they give exemption for maternity reason and consider her 12 months stay in India for 2 year qualifying period?

I believe my son is eligible for ILR, (born in India on Sep 2010 & came to UK on May 2011) please correct me if I am wrong.

As long as your wife entered the UK at least 2 years ago, it does not matter. Absence is not counted for PBS dependants.

She entered UK on Sep 2009; So I believe it should be ok.
