Tier 2 application - min hrs criteria??

Tier 2 application - min hrs criteria??

Hello,

My husband has been offered a job which pays 21,000 on a pro-rata basis. The number of working hrs is 28 and this is a permanent post. My question is : will this have any impact on our Tier 2 visa application - as the net salary is abv the 20,000 mark but on a pro-rata basis. We are trying to switch from PSW to Tier 2.

Do the number of hrs worked for have any impact on the application?

Numbers of hours and related salary do have direct impact on Tier 2 visa application.

Hi Agastya80

You gave the link to the codes of practice which sets our salary levels for various occupations. However, the question remains if there is a minimum hours of work given for Tier 2 (General) jobs? The only reference I found to this in the policy guidance is for shortage occupations where it is 30 hours.

Hi Manci, if the job is in Shortage Occupation list then the requirement is atleast 30 hours a week.

the link i copied was for all job soc code and salary levels based on 37.5hrs a week. However, salaries for different hours will have to be calculated on pro-rated basis.....
for example
if salary is 21000 per annum for 28hrs/week then it turns out to be approx 14.43/hour. If working 37.5hrs/week then it will be more than 28000 per annum. So if this is the requirement for the SOC code then it should be fine.

point 69 - refers to maximum working hours for calculating salary. Nothing about minimum working hours
However for Shortage occupations it has be minimum 30 hours a week(point 78

I am not too sure if anything is mentioned about minimum working hours requirement for jobs not listed in shortage occupations list.
