DISCRETIONARY LEAVES AND BENEFITS

Post by Kashif Butt » Sat Mar 17, 2012 2:10 pm

Hi Sir

My question is that my wife got discretionary leave to remain in UK till 2014. I got indefinite leave to remain in Dec 2011. My baby was born in UK in Dec 2010. because of we were planning to travel abroad soon so I did not use MN1 form for my baby rather applied with my wife and my baby also got discretionary leave to remain till 2014. I am applying MN1 form for my baby this month. me and my family are Pakistani . I am also looking for family tax credit and child benefits to claim . Can someone kindly advise me

1 - Will current discretionay leave to remain of my child will have negative effect on her MN1 form request?

2 - Is this advisable to take Child benefit and family tax credit. Will it effect wrongly on my wife's extension in 2014. or on my child's MN1 Form application ? I checked my wife's visa there is NO restriction of resource of pubic fund . But end of the day she got visa as her husband (myself) and baby is here. and if her husband i.e ME take benefits to support her will this fact cause problem in further extension in 2014 or possible indefinite leave to remain in 2016. as she arrived in UK in 2006.

3 - Is this advisable to switch her visa status from discretionary to MY dependant as I got ILR anyways.

Many Thanks in advance

kashif
