Italian Passport

Italian Passport

Need help !

Dvla lost my passport and now due to the Italian law my wife or soon to be ex- wife needs to give consent to renew my passport, which off course she now refuse to do.Oh i need to mention that we have a child thats under 18 and staying with his mom.I need to know how to get around this or how do I follow up with Dvla to trace my passport.

Please need help.

I'm not sure if I understand what this is about.

The DVLA lost your passport, complain to them. If they can't find it, you should contact Italian consulate and follow their advice in terms of lost passports.

All of those things done but no joy, its Italian law that when you have a child under the age of 18 you need the other parents consent to get or renew a passport. And this will not happen as we are separated and going trough a divorce.

The applicant has minor children (children under the age of eighteen)

When a parent of a minor child applies to have a passport re-issued or renewed, consent must be given by the other parent, regardless of whether the child's name appears in the passport or not. Consent must be given in writing by attending at the Consulate in person with valid photo ID. If the other parent resides outside the Consulate's jurisdiction, consent may be given at the Italian City Hall of residency or at the nearest Italian Consulate

If the parent of the minor child from whom consent is required, cannot or refuses to attend in person (particularly in cases of separation or divorce), the passport applicant is required to provide all documents related to the separation or divorce, as well as to the custody of the child. The address of the ex-spouse must be provided as well. The Consulate will then proceed to write to the ex-spouse to enquire about any valid reasons as to why the applicant's passport should not be re-issued or renewed. After fifteen days, the Consul General is empowered to decide on the matter, based on the information provided. If the minor child resides in Italy, the matter is decided by a Judge of an Italian Court with jurisdiction

Ok, sound like it's real pain in the neck, but reading the procedure it would appear that consent can't be unreasonably held. I'm not Italian and would not have to go through that. My country insists that both parents of minors sign off agreeing to their child getting a passport, but that's a different matter to yours.

Why is she withholding permission? Is the upcoming divorce not something she wants to reach conclusion with?

Also note that you can travel throughout Europe with just your Italian national ID card.

Breakups are very complicated matters. I hope it all works out for the OP.
