Newbie - help needed on documents for set (m) indefinate lea

Newbie - help needed on documents for set (m) indefinate lea

I am British citizen, and my wife's 2 year spouse visa expires very soon.

I am filling the indefiate leave to remian forn (set m),

at the end of section 6a it requests various documents in my wifes name,

because we live with my parents we dont have any. Neither do we have

anything in joint names.

What do i do?

You must have something. Bank statements; is she registered at a doctors surgery; does she work;has she a national insurance number? You must have something that shows she is resident in this country.
something with your address printed on it in her name.

Only a letter from the doctor and the nhs card, and thats it

Those are the only documents in your wife's name? Nothing else at all? No bank account? No payslips or P60? No Tax Credits claim? No car? No motor insurance? No AA, RAC or the like? No child's birth certificate? No life insurance on your wife's life?

What can you do? Look at those examples of types of evidence as mentioned on the form SET(M), and think long and hard about what is actually in your wife's name ... or your joint names!

I have just changed over the BT account to her name and remembered the gas is her name too.

She is currently at college, so will any correspondence from there be valid?

I just knew you would find other evidence!

Given that you are struggling, you should consider including anything at all with her name on issued by any type of organisation at all. Certainly anything from the college should be used, as long as it has her name and address on it.

After all, what are you trying to do here? Prove that the two of you live together .... at the same address!

She has no bank account or building society account? If so get one open in her name, or in your joint names.

again John much appreciate your help here,

i feel much better when someone gives positive advice.

Unfortunately all banks in my area wont open an account because the bill has my surname, however the passport has her maiden name (i.e here previous surname). Although I have a marriage certificate to prove her identity, but it is an indian certificate.

To make things even more complicated the visa expires on 13th of Sept 2006.

In total I think I have 5 different documents with her name and address on it. (NHS card, correspondence from GP, COllege letters, british gas bill, bt bill)

can she use tesco club cards etc.

ANd I definately know we have nothing in joint names.


DO you think I will have a problem if i send my application witht he above?

Yes, OK, not the best of evidence, but you really are struggling here!

Get your parents to write a letter saying when the two of you moved in and that you are still living there. Ordinarily I would not suggest that but it is better to supply that sort of thing rather than be short on the number of items she needs.

Your wife is Indian? Is she on the Electoral Register? Indeed are you on the Electoral Register at your parents' house?

Keep thinking! Along the same idea as Tesco card, any Nectar card? WH Smiths card? Boots Advantage Card? Anything at all that has generated correspondence in your wife's name?

Please forgive my intrusion but I am just interested why you have your gas bill and BT in your wifes name but you have not added her to your bank account. If you show a marriage cert showing the change of name then you can get an account with her name. Not that this helps your settlement visa

Yes my parents are willing to write me aletter confirming that we have lived together for the entire period.

Why is your wife not on the Electoral Register?

Hmmm .... my wife and I married in Thailand. We have never encountered any problem in the UK proving marriage but we always ensure that we produce not just the Thai original certificate but also the Certified Translation of it into English. Those two pieces of paper are produced together, never separately. Never a problem proving the marriage.

Is your Indian marriage certificate in English? If not do you have a Certified Translation of it into English?

British, Irish, Commonwealth citizens are entitled (in fact, required) to be on the electoral register if they are living in the UK, so your wife really ought to be on the electoral register. They are entitled to vote at all UK elections, including Westminster and European elections. (Other EU citizens - i.e. not Maltese or Cypriot (who are also Commonwealth citizens), not Irish, not British - are also required to be on the electoral register but they may not vote at Westminster elections.)

Well when i say shes not i mean we sent the equest off about a month but the new register wont be printed till the 1st of December.

John I have both the Indian version and the english version, but they still refused.

We have an appointment with the building society in about an hour so fingers crossed.

In regards to the documents I have, do you think I will struggle?

Take both with you to the Building Society.

Have you tried wherever you bank to open an account for your wife?

Why not add her to yours that is so much easier
Most banks just accept as long as you have one proof of address
I assume she has been in uk nearly the two years hence the renewal
New usually under 6 months can open an HSBC passport account

she called to request a national insurance no, and hopefully we will get a written confirmation for an interview

Hi Nasir325Ic,

You mentioned that your wife's spouse visa expires on 13th Sepetmber and you were in teh process of applying for the ILR for her.

Hopefully you have got the ILR by now - its 14th September today:-)

Please share your experience about the ILR applicaiton and approval. Your's would have beena very unique experience since you only had a limited amount of evidence of joint bills with your wife.

Please let us know what was the outcome and i am hoping your wife has got her ILR by now.

Yes British i sent the application off on 11th by special delivery and they

recieved it on the 12th and sent me confirmation letter.


In the end there was about 10 different letters in my wife's name,

although we have lived together since she has entered UK we only had a

couple of documents which showed that. Because all previous letters etc

had been distoyed or misplaced, and we only came to know the

requirements upon reading the Set M form which was about 10 days ago.


I hope she gets her ILRas the whole family is flying to India on the 4th for

my brothers wedding.

The 4th of what? October? As you made a postal application I think you need to accept that there is no guarantee that the ILR visa will be in the passport by 4th October. They deal with about 70% of applications within 4 weeks and you are not even talking about 4 weeks.

But hopefully it will come through in time.
