Hello there

I have a question regrading cohabitation for 2 years.

I am on tier1 (general) and eligible for ILR in June end this year.
My wife is on tier 1 dependent since August 2010. We have been living together since then. but only proof of cohabitation I have got is joint bank account which was not opened until late september 2010.

I want to apply together with my wife for ILR.

How early can I apply.

When did you marry and was she on the UK in another category of leave prior to her arrival in August 2010?

We got married in early June.. Got tier 1 dependent for her in July and age joined me here in UK in mid August.

So you have two options:

You can both apply for ILR jointly in mid July (28 days before the 2nd anniversary of her arrival date).

or

You can apply for ILR in June and she can apply for FLR. When her FLR is granted, she can then apply for ILR.

Delaying your own ILR application by just one month so you may apply together would be the more expedient and economical choice.

Thanks so much for the reply.. Just wanted to ask what evidene I can show for cohabitation of 2 years.. As earlier I wrote that joint account wasn't open till late September.. The only evidence I have got at the moment..

Hi

I suggest go through set(M) section 11 note 8 for acceptable documents. they need 6 letters/docs covering the period and should be from 3 different source.

My application was put on hold because I had taken only the bank account statement although I had letters from GP, bank letters council tax letters I thought bank statement is enough SET(O) document requirements are not clear.

You dont have to take for every month I would say take every 4 months for eg., council tax letter for one month and bank staement for an other month 4 months later like this spread across for the last 2 years you should be ok. If you cannot provide joint names provide individual docs in the same month.
