cooling off period - new rules form 6th April 2012

Post by smoothraj » Tue Mar 20, 2012 2:18 pm

under the new proposed changes that will come into effect from 6th April 2012..

"introducing a 'cooling-off period' across all the Tier 2 routes. Tier 2 migrants will need to wait for 12 months from the expiry of their previous visa before they may apply for a further Tier 2 visa."

would this cooling period be applicable for all tier-2 migrants, if they wish to apply for extension under the same category? what happens in the following scenarious..

a) if the current tier-2 ICT (issued before 6th April 2010) work permit expires end of May then would the migrant be allowed to apply for extension?

b) if a tier-2 ICT holder (issued before 6th april 2010) wishes to switch employer (in-country) and apply for tier-2 gen after 6th april 2012?

regards
