ILR Eligibility - please help

Hi All,

Can someone please let me know if i will be eligible to apply for ILR this month or may be starting next month depending on the below timelines when i was in UK ?



1) I came to UK for the first time with a WokPermit in 03/2007 and left UK during 09/2007

2) I came back to UK again on 11/2007 with a new WorkPermit issued by the same employer as my previous workpermit got expired while i was outside UK

3) Being in UK i got a Tier1 Visa in 03/2008 for 3 years and got it extended for another 2 years in 04/2011

Would i be eligible to apply for ILR now or i need to wait until 11/2012 ??
because my Workpermit got expired while i was outside India and i came back to UK with a new WorkPermit ?

Can you tell us, what gap (no. of days) was there between your WP expiry and new WP? I guess as you say it will be something less than 90 days.
I am inclined to believe that if the gap is less than 90 days, you should be able to apply for ILR upto 28 days before 5th Anniversary of date of first UK landing based on initial WP.

thanks for your reply, the gap between the below 2 stages is less than 90 days

You should be fine. Gap is less than 90 days.
