Extension: ILR rule for dependant with a gap in visa

Post by varghesejim » Tue Mar 20, 2012 10:07 pm

Dear Forum members,

Me and my wife(tier 1 dependant) living in the Uk for 2years and 10 months. Our visa expires in June. As we are expecting a baby, my wife is travelling to India in May. She is planning to leave before extending visa because she needs to travel well in advance for her delivery.

Is it ok if we apply for my wife's visa extension from India(with the baby)?

Is it difficult to extend dependant visa from out-of country?

Will it affect ILR if she have a period of visa gap? I know that she need not stay continuosly in UK for 2 years, but what if she dont have visa for the period she is not here in UK?

For simplicity, consider having baby born in the UK. Else, both baby and mother may apply for dependent visas.

Shouldn't effect ILR.

Very helpful. Thank you, Vinny.

We considered having the baby here, but it is very diffiicult for us to manage. Also, we cannot see any benefit if the baby becoming citizen when we get ILR.

A benefit is saving costs of applying for UK/other visas.
