Family Visitor Visa Refused from India

Hello All,

My sister applied for family visitor visa from India to visit us in the UK and was rejected for the most common reason "lack of evidence to prove that she will return back to India".

I had provided all necessary documents from my end as Sponsor and following were the documents that she had submitted from her end :

• Pay slips for last 6 months
• Letter from her employer confirming employment.
• Salaried bank statements for last 6 months
• Fixed deposit statement
• Sponsor’s Visa and Passport pages
• Sponsor’s Employment letter from his employer
• Sponsor’s Salary slips for last 6 months
• Sponsor’s Bank statement for last 6 months
• Sponsor’s UK Address proof – Rent Agreement
• Sponsor’s Council Tax bill


The caseworker seem to be fine with all the documents submitted except that he wanted applicant's(my sister) employer to confirm the vacation and work resumption dates which would convince him to approve her visa.

I am now considering to re-apply rather than go through the process of appeal.

Will now ensure that applicant's employer provides a NO OBJECTION LETTER stating the approved vacation dates and the date of her work resuming.

Kindly let me know your thoughts about the same

If the ECO had said that she has no ties to India and left it at that, I would have suggested appeal because a new application would not change that mindset. However, if the ECO has indicated everything is fine except for one requirement, and you can satisfy that requirement, reapplying (at a mere 76 pounds) is certainly better than waiting 6 months for a FTT judge to make a decision on the ECO's mindset.

Thanks for your feedback.

Although ECO haven't directly mentioned about their assessment on other aspects of application,the refusal letter states that they expected the employer letter to hold the vacation start and end dates and that her employment will remain active until she returns back from the UK.

I understand appeal process is cumbersome and hence may go with fresh application with updated employer letter and hope it gets approved this time.
