Indefinite Leave to Remain Elligibility

Friends i need help in deciding whether to go for ILR application or apply for extension before end date of my visa.

I got HSMP VISA stamped on 27/12/2007, I entered UK on 05/02/2008 (thats after 39 days from stamping).

Following were my days away from UK making it total 147 so i hope its ok with 180 days rule..and also continuous 90 day rule.

I got visa until 11/01/2013, I am elligible for ILR on 6th Jan 2013, but i am thinking will they accept my ILR application ??? as i entered after 39 days??? i read in forums... that if we enter UK after 28 days of stamping then we must go for FLR before ILR... please suggest.
