Im an Israeli citizen who came to the UK 8.5 years ago initially as a student , I then got married in a Registry Office here in 2004 to a British Citizen (6years of which I lived on an limited leave to remain visa ) and I have 2 young Sons and a third baby on the way. I lost my passport and was unaware that my Visa had expired consequently I now have no Visa and need urgent assitance in resolving this situation. I'm actually entitled to indefinite leave to remain but the fact that my Visa has expired is complicating my ability to apply as it Immigration here requires me to complete my Visa application from Israel which I am advised will take 8 weeks (it used to be on the spot) and as a business owner this is simply not a viable option for me. Also the fact that my Wife is due to give birth soon means that I must be with her and my family to support them. I have evidence to prove our marriage is genuine and lived together all this time, we have bankstatements and both work - Im an overstayer will they refuse my application automatically? What European human rights do we have or only option is applying SET(M)

I KNOW I can apply now for my visa from here but is it possible that they will reject me just for overstaying?? Please help Im about 7 months lat ein applying and so so scared - i have everything to lose

What category was your limited status prior to overstaying?

Im told I could be rejected because Im here illegally by 6months - please help worry making me ill

Hi always had limited time to remain Visa as kept missing ILR as couldnt afford it, I can actually now afford it as have a thriving business

Sorry, can't help, I'm not professional. But please don't worry to much, there must be a way. You stayed most of the time legally. Somebody will help you here. If not, then use professional help from UK solicitor but check that company is accredited in professional organizations.

Please don't worry, I am sure you will be fine. There is anti-immigration rhetoric in the news now but it is not against people like you, it is against those who abused the law.

Remember the song - "cause if you worry you make it double, so don't worry..." You are on the right track right now of getting help, soon you will know more information and it will become easier. The most worrying thing is not to be sure what to and what is right, I know this feeling. You lived in this country for so long and this unpleasant situation. But you will solve it, I'm sure. Worrying too much would not help. UK is a civilized country with independent courts, so there will be a way to solve it. And, at the end of the day, even if you will have to apply from Israel, this is not the worst country in world as well. I love Israel!

Thank you for listening, I have spoken to a Solicitor and told go for ILR but Im learning more through here, I am glad you love Israel, if only th eworld saw the real picture!!

I cant afford to leave my busines for 8 weeks, or Id go and do it there, my wife is due soon I cant leave her alone iwth 2 kids either!!

Well, I would do what solicitor advised. Only be sure it is good reliable solicitor accredited in independent bodies. I would also try to do it inside the country, just in case.

I am wondering how likely it is that they will reject him just on basis that its a bit late - I am going to send in a letter from our local MP also to support the application, we really put a lot into the community and if he were to be rejected we would be forced as a family to be apart???

Its a nightmare and if rejected I dont think we can even appeal it so Im told - what are your thoughts please
