spouse residence help appeal?

Post by noclue » Fri Mar 23, 2012 10:01 am

hi,

basically i was wondering if my residence visa for Algeria is good to provided in our appeal case to show im living here in algeria and that they have given me residence and why not grant his settlement visa?

sorry if my wordering is wrong i just want to know if they will just turn round and say to me at the appeal why dont i just live there with him instead of giving him his visa to the uk. are they that horrible?

has anyone ever done this or know how it will go down in the appeal?

thanks

Hi noclue

As long as you are a British citizen or on ILR, no one is going to ask you to leave the country to live with your spouse/partner. Its the freedom of choice that you both have and its your decision to stay where you want to stay.

So as far as I know, the judge won't ask this question but even if he/she does just make sure that you tell them about your life here in the UK. That you are settled here, your family, friends etc.

Hope this helps.
