ILR for elderly parents under 65 on compassionate grounds

Post by sg2at » Sun Mar 25, 2012 7:39 am

I am an ILR holder and my parents are visiting me in UK on family visitor visa.

I am looking to apply for settlement for my elderly parents Mom 59 and Dad 63. Both have medical conditions and my father is severely disabled. Mother is the sole carer back at home in Pakistan and she has developed some medical conditions of her own that limit her ability to care for her severely disabled husband.

Fathers medical: disabled from right leg, right arm, cannot speak, heart problems, high blood pressure and diabetes.

Mother medical: Heart problem (cholesterol related), angina, high blood pressure.

Change of circumstances since applying for UK visit visa: my mother has developed a severe gastritis (special dietary requirements now - otherwise vomiting starts). This has limited her ability to do house work and care for my permanently disabled father. Her brother is the occasional carer in Pakistan who lives in the same street however he is having to move house on a driving distance away from my parents' accommodation and will not be able to visit them regularly to assist in care needs etc.

I and the wife are considering taking up full responsibilities of our ill parents who are currently visiting us.

I am the only son.

I am able to maintain and accommodate them in UK.

They are mainly financially dependant upon my income however they have small income of their own (father's pension and rent from two houses in village - this income is not regular).

My evidence of financial support in past 8 months is slightly complicated? I have had my parents in UK since 20-Nov 2011. Prior to that, I have approximately four months worth of western union money transfer slips (dating back to Aug 2011-Oct 2011). The SET(F) form asks for money transfer records of 6 months before the date of application. Since they are living with me for past five months if I attach one month worth of western union money transfers then would they accept that?

I am attaching following documents to support the application.

a) Medical reports from a registered GP from UK
Payment receipts and tests carried out whilst attending A&E in Pakistan.
c) Medical prescriptions from gastroenterologist in Pakistan.
d) Medical prescriptions from cardiologist in Pakistan.
e) Affidavit from the brother of my mom explaining the house move.
f) Affidavit from the brother of my mom explaining his inability to continue the level of support he previously provided.
g) Personal Statements.
h) Western Union receipts – money received by my mother.
I) Letter of support from a close friend of the Sponsor.
j) Letter of support from the real daughter of applicants.
h) Letter of support from the daughter-in-law of applicants.

Added complication is that the mode of payment to parents has been western union from Aug-2011 till present. However the financial support in previous 3 years has been through the bank account of the brother of my Mom.

My parents do not have a bank account and they have been relying on their ‘occasional carer’ to help receive the funds from myself.

I am looking for advice on following items:
1) Timing of application i.e. before 6th April or just before the end of my father's 6 month visit visa (expiry 2-May 2012), Mother's stay will expire on 20th-May 2012?
2) Does this case carry compassionate grounds in the view of readers of this forum?
3) Shall I stick to one month’s worth of financial payments made through western union and explain that parents are visiting me from past five months prior to that?
4) Any other comments of similar experience welcome?
5) Does any one know if the fees are going to go up from £1815 per applicant?
6) What should a medical report from UK GP entail?
7) Is it possible that if I use the annual funds transfer to the carer then these may not be regarded genuine? Can anyone comment on that plz?

Thanks a lot for reading the detail.

Your advice will be me much valuable.
