Hi,

I am on T1, wife on dependent.. Expecting twins in next 3 months... Will I get any benefits?

Our visa has No Public funds written. will i get any relaxation in tax? council tax? anything?

We both are Indian... I am in UK since 2010 and wife is in uk since 2011 our visa says no public funds.

Assuming you did not work in Canada before coming to the UK, you will not be able to claim any benefits that come within the definition of public funds (e.g. child benefit, child tax credit). You are not entitled to any relaxation in tax due to having a child. You cannot claim council tax benefit.

If your wife has been working she may be entitled to Statutory Maternity Pay or Maternity Allowance as these do not come within the definition of public funds.

Do not listen to any health visitor, midwife or other healthcare professional who insists that you apply for child benefit a child tax credit as 'HMRC will tell you whether you are eligible' - they get it wrong and as a result you would be breaching the conditions of your visa.

My wife is never worked... Presently she has got maternity exception certificate and all medicines/scanning/birth is free. She has NI card but has never paid NI because she has never earned.

I do pay NI contibutions.

Is it legal what she is getting? i mean maternity exception card and free treatment

She is totally entitled to use the NHS without charge, as are you! That will include all maternity-related treatments.

As regards the "maternity exception card", your wife is certainly entitled to use that to obtain free NHS prescriptions, and free NHS dentistry, during the pregnancy and for one year after. Any such use is not within the definition of "Public Funds".

Likewise, the twins, there will be a perfect entitlement for them to have free NHS prescriptions and free NHS dentistry, while they are a child.
