I am English born and bred so everything is fine with me. My girlfried is Turkish and has been in this country for 10years. Her right to remain ended in early 2005 so officially she has been an overstayer for the last 1 1/2 years.
We have been together for over two years and have been living together for over 18months. We first met about 5years ago.
We have been looking at all avenues to try and resolve her situation properly, but i think the best option for us would be to go back to Turkey and get married and then apply for a spouse visa. Or what about a fiance visa? could i stay here and she just go back to Turkey to apply for fiance visa?
But what i need to know is about the fact that she applied for asylum here and has been an overstayer for about a year, so what would happen if we went back to turkey to get married and tried to apply for spouse/fiance visa? Would she get rejected because of overstaying/applying for asylum??
Is there any amount of time we should wait before trying to come back? maybe stay over for a few months?
i can prove i have enough money and a flat and everything to take care of her.
So what are our options what is the best thing to do? we dont want to go to turkey if she will not get back into the country. shes spent 10years here and has a settled life, we dont want to ruin it.
but i still think its the best option to get her to live in UK legally,either get spouse or fiance visa.
please any information or advice would be great. what should we do?
