Extension of the EEA FP

Post by altair19g » Thu Mar 29, 2012 3:04 pm

Hello!
I am in the UK for 3 months on a visa EEA FP, expires in June. The site HO read that EEA FP does not extend, and what I should to submit the form to the EEA2 Residence card. But we think, that RC makes about 6 months, and if there'll failure - I'll be deported from the country without the right of return. On other forums on the UK respond that the card can be served almost immediately upon arrival. My husband's friends used the help of a lawyer, and say that he was prolonging EEA FP.
I have arranged to obtain RC, if not a "but": I was told that Resident card is not visa, and I can not leave and enter the UK. Well, sort of a residence permit, without the right to leave the country, and if I leave, for example, on vacation, then I need to return the EEA FP or something like that

Tell me please, what should i do?

altair19g,

There are many inaccuracies in your post (in almost every single sentence).

* There is no way to extend the EEA FP (but you don't really need to). You can apply for a new one outside the UK.
* I would not use the services of your friends lawyer.
* Documentation from the HO is optional under EEA regulations. You don't need to have one.
* RC can take up to 6 months but normally takes about 2-3 months.
* You won't get deported if your application is refused.
* The RC can be used to leave and enter the UK.
* If you travel while waiting for a RC to be issued, you might need to apply for another EEA FP if you are a visa national.

I suggest you read the following pages on the HO website:

Rights and responsibilities

Residence documents for non-EEA family members of EEA nationals.
