I am moving to England with my British husband from Canada, in May on my recently obtained Settlement Visa.
I have two queries in regards to having no recourse to public funds.
At the outset I wish to clarify we both have worked for all of our adult life and so do not and have not looked upon benefits as a way out of this. But, until we find employment in the UK we want to know what we can claim for.
1) Does this only apply to me, or is my Husband (as my sponsor) also not allowed to claim benefits (as he usually would be able to)?
2) Are there any guidelines to help a person know what he can or cannot claim for, that would not be classed as 'recourse to public funds'? (For instance, would we be able to claim Housing Benefit or Job Seekers Allowance? What benefits would be legally entitled to, that would not be going against the Settlement Visa guidelines?) I just wouldn't want to do anything that would jeopardise my ILR, yet I'm not sure what is legally ok to claim for.
Apologies if the questions seem vague or obvious, but I'm new to all this and it can seem daunting at times.
Thank you,
Jen
