divorced holder of EEA family permit UK

Post by ni3oni3o » Sat Mar 31, 2012 9:30 am

Hello,

I have just received the decree absolute after marriage resolution from my EU wife. We are both currently out of UK, and as I havent completed 3 years of marriage, I am not entitled to request permit to remain in UK. however, neither myself or my ex wife have informed UKBA that we are divorced, hence, I still have the residency card. do UK civil justice courts usually inform UKBA of divorce when takes place? if we continue to not inform UKBA, will I still have the residence permit? I dont want to live in UK, but its nice to have an easy way to enter the UK whenever I feel like having a week off from work without worrying about applying for visit visa.

Thank you

Civil courts or divorce courts they do not interfere with your immigration status, the only time that the UKBA can be alerted when there is a criminal offence commited and when an individual has been charged or convicted with a crime. In your case if your wife report you to the HO your residence will be revoked but if she doesn't than you can keep it for the remaining period left, the only issue that when you enter the UK you will be asked by an immigration officer informations regarding your wife and her whereabouts as routine check, if you mention that you have been divorced and your wife lives outside the Uk it is most likely that they will cancel your RC and expel you there and then.
