Help - Complex Situation

Hi,

Our nerves getting tense, We need some consultant/accountant having experience of dealing with with HSMP extensions under JR.

As yesterday my husband called their customer services and inquired that we applied for HSMP in September 2006, so whether our case falls under HSMP JR and which form to use for extension, the lady their said that , you have to use Tier 1 General Form for the extenion , my husband told her that as we have applied before Nov 2006 our case falls under HSMP JR and for that we have to use FLR Tier1 HSMP form. The lady put my husband on hold to reconfirm and after abt 2 minutes of hold she said that you can use any of the two forms , then my husband told her that the guidance for both the forms are different and she didnt have any suitable answer.

So plz seniors advise us, and also someone in a similar situation or have have passed the similar situation can suggest us some expert to deal with the UKBA.

I am assuming your current immigration category is Tier 1 General

This is what the Tier 1 HSMP guidance says:

Who can apply on form FLR Tier 1 (HSMP)
2) You should only use this application form if you
were granted leave to enter or remain under the
Highly Skilled Migrant Programme and
submitted your initial application under HSMP
prior to 7 November 2006 and are seeking to
extend your leave within this category for a
further period.


I guess Tier 1 HSMP form is only for people who are currently on HSMP & want to switch to Tier 1

Since you are already on Tier 1, you should be using the T1 Gen extension form

Thnaks for the reply Manka,

We filed our intitial HSMP application in Sep 2006, case went in appeal, won the appeal and atlast landed in UK in March 2010, Our Visa Says Highly Skilled Migrant Visa and it was issued for three years ending March 2013.

We the whole family are really confused.

I think you need to engage an immigration consultant who can give professional advice

There are so many peaple who must have gone through the HSMP extension under Jucial Review, no one recomending me an experienced consultant.

That is because of simple thumb rule - Advertisement of any sort is not recommended on forum. And no one would want to be blamed if god forbid, anything has to go wrong with your application.

I suggest you rather google your needs and not wait here

Dear you don,t need an immigration adviser. Most of them know nothing like people sitting in ukba. Ukba website is the best guide. Just follow the on line applying form which you can down load as well. This is the only place which is updated regularly.

Your form is defiantly FLR (hsmp) tier1

It clearly states who should fill it. If you go to tier1 then you need to prove your income to score points as well which is not required in your case. You believe me you know more than solicitors just because when you read you read it for your self and not for some one else and for your particular case. They are changing rules every day and it is very difficult for any body to keep track of it. Best of luck

dude, people go to immigration consultants as they have practical experience of handling similar cases & know the outcome as well as what may be the best approach, not because they know anything more or less than us

not every thing/situation is written in black & white in the guidance notes

My view only:

Write to the UKBA (e-mail) regarding the type of the form and apply/use accordingly. This e-mail would be a good reference. The feedback using phone cannot be a reference.


If there is wrong form selection then e-mail could be used as a refernce. U might attach the reply of the e-mail with the application with a cover letter.

I have no idea about the e-mail address of UKBA but should have one. Could be asked for e-mail addss over the phone.

also one more clarification
Following the High Court Judgment of 8 April 2008, migrants who obtained leave to enter or remain based on a letter of approval issued under the HSMP criteria in place before the programme was suspended on 7 November 2006 should be considered against the extension criteria in place when they joined the programme
Can some senior plz explain this?

This means whether HSMP approval letter must be issued before Nov 07, 2006

or

Application filed or Home Office Acknowledgement received before Nov 07, 2006

This will make us a lot relieved.
