Absence over 90 days

Post by acpula » Mon Apr 02, 2012 12:40 pm

Hi,

Thanks for the help on this forum.

I have completed my project and visited india on 26th Feb(I left the company after visiting india)
I came back to UK after 104 days in search of a job.

As my company pay for the remaining holidays, i was paid for 15 days in the month of march.

How does UKBA count this? As my company letter shows that my last day was on 26th Feb, but i was paid for the holidays in the month of March.

Can anyone suggest how should i count for this? Is it 104-15 =89 days Unpaid?

Am i eligible now for applying SET(o) with this issue(over 90 days)?

Unfortunately i dint receive my payslip for these holidays. I can only provide them my bank statements that i was paid.

Thanks

Unfortunately not. By spending over 90 days out and without a pay slip to prove you were economically active in the UK, your 5 year counter for ILR has been reset. You should extend your current Limited Leave to Remain (Tier 1/Tier 2?)
