Entry to UK when current visa about to expire

Hi,

I'm currently in UK working under the intera company transfer arrangement. My wife and daugther had applied for a visa last year (Tier 2 dependant) and they entered the UK in November 2011. Their visas due to expire on 30th May 2012. She had travelled to India on 1st Februray 2012 and plans to return to UK on 5th May 2012.

I plan to extend my visa whilst in the UK along with my dependants. My question is would my wife and daugther be refused entry into the UK on 5th May as at that point they would have only 24 days left for their visas to expire?

Does your visa also expire on 30 May and do you plan to apply for extensions for yourself and family once your wife returns on 5 May (and before 30 May)?

Yes, mine expires on 30th May 2012 as well. The plan is to apply for extension for myself and family.

Hi James

I think the 24 days leave that your wife and daughter will have remaining when they return to the UK on 5 May will be sufficient not to cause any problems at the border.

However, just to make sure, call the UKBA Immigration Enquiry Bureau (0870 606 7766 - easiest to get through mid-afternoon) and ask them to confirm this.

Hi Manci,

Just an update.

I had called UKBA today and they informed me that my wife would not be refused entry even if she lands on the 29th of May. As long she enters the UK within the leave to remain period she'll be allowed to enter UK, which confirm what you had posted earlier.

Hi James

Suggest you make a note of the date and time of the conversation with UKBA (and the name of the advisor if you remember it) and send it to your wife so that she has it with her when she returns to the UK and can show it to the Immigration Officer, if needed.

UKBA record all telephone conversations.

Hi vinny,

What I understand from 321A is that even if my family returns on 29th May 2012 (one day before visa expires) they will not have problems entering the UK unless the situation is either one or more points listed under 321A. Please correct me if I'm wrong.
