urgent attention please - ILR for Teir1 dependant wife

Hi,

I am aware of the fact that my wife must spend 2 years before she applies for ILR. Her 2 years on tier1 dependant visa are completing in May 2012.

The question is, can she apply 28 days before qualifying period lets say in April 2012?

I will appreciate quick responses.

You should actually have asked for your self. If I am not wrong, you are the Tier 1 Visa holder and your visa is expiring on May2012. You should be applying for your ILR then with you your wife can get ILR too.

You must have spent 5 years (in most cases) before applying for ILR.

You can apply 28 days before when you become eligible for ILR.

Hi,

Thanks for replying.

I became eligible in Nov 2011 so i have already completed my 5 years (WP1+WP2+Tier1). I was waiting for my wife so that we can apply together.

Since we have travel plans end of April this month. i was looking forward to take same day service and fly.

So can my wife being tier1 dependant apply with 28 days qualifying period of 2 years or not?

I will appreciate clarification.

Yes she can. As long as she has stayed for 1 year, eleven months and two days in UK and you can prove the subsisting relationship by providing cohibitation documents.

Yes she will be in UK for 1 year 11 months & 2days by that time.

Have you experienced this? or read it somewhere? it is explicitly qouted for Spouses of Settled or british people but not for tier1 dependant.

Although i have called UKBA advisors and three of them said yes she can but one of them negates. she said no she has to complete 2 years so i was bit confused.
