FPN with 3 points for Speeding - ILR?

FPN with 3 points for Speeding - ILR?

Dear all,
I'm on a Tier-1 visa and intend on applying for ILR in 18months. I've just got a FPN + 3 points endorsed on my licence for speeding.
I know this doesn't have any implications on Tier-1 extensions, but will I have any issues when applying for ILR and then for naturalisation?

Please note that the letter I received states that it is a FPN with a £60 fine and 3 points endorsement.

Question for OP though - Where you convicted in court for your driving offence? How long ago did this happen?

it just came through the post and the words "fixed penality notice" are mentioned.. no court/judge involved in my case..

Apologies, I missed that out. You should be fine as there was no court involved. Had your offence been of serious nature, ie speeding at 60mph in 30mph zone, you would have been taken to the court and may have had implications on your ILR

What does "issued by a court" mean under the context of "Fixed Penalty fine" with 3 points. - Is it considered a "conviction" only if you are physically taken to a court and issued a penalty/fine/points or CAN COURTS also issue the "conviction" without you phyically going to court and appearing before a magistrate?

You can be prosecuted/convicted in absence. So, to answer your question that whether or not court can issue a conviction, YES, they can. That said, your comments arent quite clear on background to the matter so I have only generalised.

what is a convicting court code ? if convicted through a court (either with a physical presence or an absence) I think the "Date of Conviction" column in the "Edorsements" section of the counterpart driving licence will contain the date on which the conviction would have happened - if this column has no value or empty then I think this is considered as a "non criminal" offence and does not have to be disclosed on the ILR application or a Tier 1 General extension application as the Home office have clearly mentioned not to worry about traffic offenses such as "FIXED PENALTY" unless issued in court (and by meaning "issued in court" I am guessing they mean that it is issued in a court when you are physically present there or even if done in your absesnce this column is populated with a date"

Am I correct?

I received Notice of Intended prosecution which followed with conditional offer of fixed penalty 3 points and £100 fine.

DId not receive any court summons or I pleaded guilty over post.

But my DVLA record says
You have3 current penalty points
TS10
Penalty points: 3

Offence details
TS10: Failing to comply with traffic light signals
Penalty points: 3
Court/Fixed penalty office
2572: North London Magistrates' Court


Does it mean I need to declare it, please advise
