28 day rule problem

28 day rule problem

I entered UK initially on 29th of April 2008 on a work permit. I got my Tier 1 visa initially from the 22nd of August to 2008. I went for my renewal on the 30th of march 2010 (trying to save some money ) and the visa was extended only till 31st of March 2013 which is a Sunday

This means that i have to apply for my Indefinite Leave to remain visa on the 29th of March which is 31 days before my actual eligibility date of 29th April 2013. The ILR website says that the earliest date that i can apply for ILR is 28 days before the actual date which is the 2nd of April which still means that i would be short by 2 days.

Can you please let me know what are the options available for me. can i apply ILR in the last week of March 2013 or is there any other options available ?

Your options are:

1. Extend the Tier 1 (Expensive but safe)

2. Put in the application in mail and hope that by the time the application is opened 3 days have passed and you're in the 28 days limit (not expensive but risky)

This is not correct as the date of posting by Royal Mail is considered as the application date.

You should be okay if you satisfy the ILR requirements on the date of the decision.
