How to appeal for sister refused family visit visa.

Post by thetoothfairy » Sun Apr 08, 2012 11:02 am

Hello everyone,
My sister was refused a visa on the following basis :

1. No evidence of personal savings
2. She is unmarried with no dependent children
3. None of the money for the visit to the UK is hers
4. Has not demostrated enough close ties, visible assets and personal responsibility in her personal and economic circumstances that necessitate her presence in Nigeria.
5. Failed to provide satisfactory evidence about the origin of sponsors fund ( uncle is the sponsor ) and his business or income.
6. The UKBA is unsure the evidence (bank statement) is a true reflection of the sponsor financial circumstances or that the funds are available to her.
7. Not satisfied she will be maintained and accommodated in the UK without recourse to public funds.
8. Not satisfied she will leave the UK at the end of visit as required by paragraph 41 (i) and (ii) of HC395.

She submitted a bank statement of my Uncle stating he would sponsor her and pay her flight and that the accommodation will be covered by me and my family. I also wrote it in the invitation letter that I would accommodate her and take care of her while she is here.
My uncle also wrote the sponsor letter on his company letter headed paper ( he has filling stations and all is maintained over a company name)

I am a ILR holder and she was invited by myself and wife who is a British Citizen.

Documents we are providing
- Letter from Uncle stating the funds are available and that they have the authority from him to call the bank for confirmation. He explained he is the CEO of the company and what the company comprised of. He has also put a copy of the ticket from British Airways to show the price of the ticket and also added he is sponsoring her because we lost our mum last year and none of my family has seen my little boy.
- Mum's death certificate
- Letter from a nursery school where my sister volunteers while she waits for her National Youth Corp. which is compulsory after University in Nigeria.
- A copy of sister's bank statement and authorization for the UKBA to call bank and she also states she is dependent and therefore is sponsored by family members. Her account shows various deposits from family as she does not work.
- Letter from my sister stating she has to complete her Youth Service Corp so therefore has to return to Nigeria and how it is important to visit me and my family for moral support.

I intend to go for the Oral hearing and will be taking a letter from the University Counselling team about how the death has affected my studies or should I apply by post ?

Does anyone know how to defend not being married and not having children and any other things I need to add ?

I understand this is very long to read so thank you so much for your time.
