What are my rights as a spouse of a british national?

Post by mads » Wed May 02, 2007 4:30 pm

I am on a spouse visa in the UK, have been married for 8 years and been living in the UK for two years in June. We were married in the UK in 1999 and returned to sa to live until 2005 when we emigrated to the UK.My visa is valid until 2015

I know I can apply for naturalization next year but want to find out what happens if my marriage does not make it till next year (I know it sounds awful). I am sick of my british husband telling me that I am dependent on him for being in this country and that if we split up, I'll have to return to south africa and he'll make sure our daughter stays with him as she is british... :( he's right arsy about it...
thanks guys

Once you have indefinite leave to remain, your being in the UK is not dependent on your being married.
