When to Apply as wife came to UK after 3 months of Visa issue date

Post by biziguy22 » Sun Sep 10, 2023 6:27 pm

Hello Admins / Mods,

I would like to thank you very much for all the great work you are doing by providing immensely helpful advices. I pray to Lord that He make your life easy.

Just a quick question please.

My wife is going to apply for her ILR on a 10-year route FLR-FP.

- Her first visa was issued in India on - 14/10/2013.
- She flew to UK on 23/01/2014.
- Her current visa is expiring on 29/09/2023.

Should she go ahead and apply for ILR now as her Visa is expiring in a couple of week's time?

Many Thanks,

Useful to state her full immigration to avoid confusion. She does NOT have '10 years on FLR(FP)' based on your previous posts, detail below. You mistakenly or on bad advice, did not extend her Tier 1 General Dependent visa with the incorrect belief that it was no longer possible.

She can apply for ILR based on 10 years long residence, IF she meets all the requirements such as absence limit etc, and her qualifying period starts from the date she ENTERED the UK.

• On 14 October 2017 you applied for limited leave to remain as the spouse of a British Citizen. This was granted from 18 November 2017 to 04 June 2020 under D-LTRP.1.1. (the 5-year route of Appendix FM).
• On 24 May 2020 you applied for indefinite leave to remain as the spouse of a British Citizen.
