When do I qualify for ILR

Post by kofi75 » Tue Feb 21, 2023 10:21 pm

I applied with my partner under Parent route as joint carers of my step child who is British citizen child.
The HO approved my partner and refused mine.
I applied for judicial review and the homeoffice over turned the decision and issued my leave to remain.
Since then we have renewed our LTR successfully.
We are on our last one then we can apply for indefinite.
The only issue is my wife was issued in2013 but because I had to go for judicial review to overturn my refusal, mine was issued on 2014
My question is can I apply for indefinite together with my partner this year or will have to wait next year to apply mine

What visa did you have before the first visa that was refused? When did it expire?
Where you in country or out?
No sin in failing, you just have to try and try again!

Then your legal stay starts from 2014 when visa was finally issued.

Thank you very much.We have always extended our leave to remain with my partner as the principal applicant and myself as a dependant. So I was thinking as she qualifies for indefinite this year I could apply with her as her dependant.

You don't qualify for ILR until 2024 as had been advised.
