Which is better Tier1 dependant or ILR dependant

Post by laxquery » Wed Apr 15, 2015 11:02 am

Hi,

Can someone pls advise me on my options -

Background

My husband has been working in the UK since Nov 2010 as a tier 1 general visa holder.

I joined him on Dependant visa in April 2011 and stayed with him in UK till Sept 2013.

I returned to India in Oct 2013 for medical treatment and was unable to return by Nov 2014 to renew my visa due to health issues.

I am currently in India and am looking to apply for dependant visa for myself and my son (6 months old)

My husband visa is valid till June 2017 and he is eligible to apply for ILR in Dec 2015.

My options are -

Wait till my husband applies for ILR in Dec 2015 and then apply as his ILR dependent.

Apply in April 2015 as a dependant of his Tier 1 general visa

My queries are -

Which is the better option to apply now or as dependent of a ILR holder?

If I apply a Tier 1 Dependant Visa , will my visa validity change if my husband is successful in getting a ILR? (Since my Husband's Tier 1 visa ends in 2 years , do I end up in 2 more extension ?)

If I apply as a dependant of a ILR will my visa be for a longer period ?

Will my stay in uk from march 2011 to sept 2013 be considered for my ILR if I can provide sufficient proof that I was unable to renew my visa coz of medical reasons.

Thanks for your help.

Hi..can someone pls help me with the above mentioned queries...

In a nutshell.. What I would like to know is, If i apply for a Tier 1 Dependant Visa now, will my time in UK be reset after my husband gets an ILR. And I have to spend 5 more years to apply for ILR.

Thanks in advance.

You would be able to continue extending tier 1 dependent after your husband gets ILR until you reach 5 years residence.
