Working part time can bring Mum under EUSS permit?

Hello Everyone,
I have a question plz
Can my wife apply to bring my mum from non eu country to uk under EUSS Permit? Or not because we are on benefits?
My Solicitor said one of us have to work full time to apply otherwise they will refuse.
I m non EU & my wife is an eu national with settle & pre settle. Both working part time (me 20 hours & wife 12 hours p/week) can not work full time because of wife disability with 2 kids.
Wife have disability allowance & We r on universal credit.
My mum not depend on us.

Hello

The dependency is an important eligibility criteria but the Home Office is "assuming it". It means you don't need to demonstrate it.

There are no formal financial requirements as you may find under UK routes.

However, as you described your situation, you have to be careful. An adult on your shoulders, it's a very expensive responsibility. You have to see very carefully if you can afford it or not.

Sorry for my question, but as far as I understand the mum can work if she gets or-settled status and she will not be a financial burden(if she is in capacity)

Yes she can work; in theory.

But when you take an elderly person from abroad and move that person to the UK in a very competitive market, the chances of this person integrating professionally are slim.

It's different for young people. Most are keen to learn English, study, find a job... etc. They have the motivation and the capacity to adapt. But it's not the case for elderly people. I have even seen a couple of cases where the EEA sponsor was fed up from the whole situation and its financial burden and just quit.

I am in same situation that I want to bring my Mather over in UK. I am non EU national with settled status. So will I be able to apply for my mum as I,am not sure is non EU national can sponsor?

You cannot sponsor your mom as a non EU citizen. Only an EU citizen can sponsor family from outside the EU under the EU rules.

It's possible that they refused based on that. But usually they don't even check financial circumstances. Dependency is "assumed" and the ability to provide is also "assumed". Under the EU Settlement Scheme they don't seem to check these things but it may happen. So it's a risk to take really but I have seen many getting these permits for family members without a single financial document.
