Wrongly calculated maximum stay on a Tier 2 General

Post by junaid.ilyas » Mon Mar 02, 2020 12:13 pm

Hi. I recently applied for a Tier 2 visa because I'm switching employers.

As far as I'm aware, the immigration rules state that the maximum stay on a Tier 2 General visa for someone who switched from Tier 4 is 5 years and 14 days in total. I originally switched from Tier 4 to Tier 2 General on 17-10-2015. And my previous Tier 2 BRP had the valid until date of 31-10-2020. Which gives me exactly 5 years 14 days as stated in the rule.

Now, the 'valid until' date printed on my new BRP is 05-01-2023. This gives me a total of around 7 years and 2 months on a Tier 2 visa. This should not be possible according to the rules. Do you think this error entails applying for an administrative review?

The only difference this time is that I applied for a shortage occupancy Tier 2.

Thanks.

The maximum time ANYONE can hold a Tier 2 General visa for is 6 years.

It is likely an error with the BRP as it should not have been granted for a date exceeding 17th October 2021. You need to raise this as an error or admin review.
