WTC and no recourse to public funds

You do not need to stop the payments. You can claim Tax Credits no problem as it is not considered a public fund as your spouse is not subject to immigration control. Call the HMRC back and undo the cancellation.

thanks amber for the reply. i just wanted to clarify that i am on spouse visa but my wife is a british citizen. they are paying in her account but only i work. so when i am filling the IKR do i have to tick on her box that she is getting wtc. im a little confused

Yes, do not worry about it. Put the CTC under your partner and the WTC under your name, the caseworker will know it is allowed.
