Dear Members,

I was in UK between Jul' 09 and Jan' 10 on a business visit and then continuously from Apr' 11 on T2 (ICT + G) visa. In all these years I have been out of country for a total of 513 days (less than the 540 days requirement) however of which one single absence between Jan' 10 and Apr' 11 is 465 days (more than 180 days requirement). I am wondering if any one had been in this situation where the ILR was successful? i.e breaching the single absence limit of 180 days but overall within the total limit of 540 days.

The absence is excessive and you will be refused and lose your fees. The immigration rules are crystal clear on this absence limit requirement.

There have not been any successes that I can recall for those who applied with 180 days or more in a single absence and this includes those who had an absence of just a few days over the limit due to compassionate reasons (ie parents death).

Best to apply in April 2021 if you meet the requirements at that point.
