5 year LTR to SET (M) ILR

Post by uchida » Mon Nov 09, 2015 10:00 pm

Hi Guys,

Again, I apologise if this the question I'm about to ask has been addressed in a different thread...I have searched thoroughly but came up with nothing.

My mate was issued 5 year LTR as a refugee in November 2013. He has been in a "common law" relationship for over 5 years, and the status/ length is known to UKVI as well (he made a failed application via that relationship a few years ago) He's due to apply for ILR in 2018 (if he keeps his nose clean :D :D :P ) my question is: Can he make an application for ILR via SET(M) now, on the basis the existing "common law" relationship? his partner meets all the requirements/ criteria.

P.S.: I know "common law" relationship as a term does no longer exist, it was only used to describe the sort of relationship he has.

No he cannot, because he does not hold a visa as an Unmarried Partner or spouse to qualify for Set(M). He will have to wait till 2018, there is no short cut or easy route.
