FLR(M) - Questions

Post by circle2017 » Fri Dec 30, 2016 10:34 pm

Please can someone advise me on below question?

I am British national applying for extension for my family (spouse and 2 step children born outside UK + my own 2 children UK nationals).
I am receiving child tax credit and child benefit.
1- child tax credit is under the name of myself and my spouse. I am bit concerned that will it affect the visa application since my spouse name is included on the child tax credit?
2- will Child Benefit affect my spouse visa application?

Your spouse is ineligible to claim for Child Benefit, but Tax Credit claim as joint, with you being the primary claimant, should be fine.

Earning of £24,800 required for such extension, as well as A2 certificate in English Language.

The £24,800 p.a can be from joint earnings.

There will also be a NHS Surcharge of £500 per applicant (£1500) in addition to the visa fees.

The first £16,000 of savings are disregarded.

You have a £5,800 shortfall in earned income.

Therefore £35,000 (savings) minus £16,000 (disregarded) = £19,000 (savings)
£5,800 x 2.5 (years) = £14,500 (savings)
This means you qualify with your savings as you have £4,500 in excess of the requirement.

That's assuming that your savings have been held in an accessible account for at least 6 months prior to submitting the application.

Thanks casa very kind of you sorry I have another question I am confused I am receiving two benefits ctc and cb. I could not find any section to write. Because FLR(M) Section 7B is Not Related to me. If I don't disclose these benefits? Is there any chance if they can refuse or deception? My six month shows receiving these two benefits. Thank You casa your very helpful I nearly finished my form.

You need to complete 7.6. You are the 'partner' so complete the 'your partner' column for child benefit because you are claiming child benefit. You complete the 'You' (your spouse) and the 'Your Partner' (you) column for child tax credits as you claim in joint names.

If you do not declare the benefits, yes the application can be refused.

There is only one place to fill in the benefits and I have already given advice about this point.

Have the £80,000 savings been held in an accessible account for a minimum of 6 months??

You apply under the relevant category that is in the form for savings. You also have to submit 6 months bank statements to prove the money is your and not 'borrowed'.

1. I have more questions. I am nearly finished my FLR(M) spouse of settled person with two dependant children but I checked new version of FLR(M) forms 12/2016 changes in section 13 document on page number 66 they add a new children section. I am curios which document applies on me? Can you please help me on this new children section which documents I have to provide.
2. After I completion of 7A Financial requirements its says proceed to 7C. My question is section 7B maintenance does not apply on me. My british husband receiving ctc on joint name and cb on his name. please some one explain and help section 7B does apply on me. Where do I explain these two benefits?
3. If I apply on just saving category balanced in the bank account for six months. Do they ask where money come from or just 6 month bank statement is good enough. thanks :D
