Dependant ILR visa - 5 years continous

Hi Everyone,
I have a query on my wife's ILR visa.
She came to U.K on Sept 2010 in Student visa, and later she switched over to PSW visa in December 2011.
Then after that she switched over to Tier 1 dependant visa on Dec 2013.

I am in Tier 1 General Visa and planned to apply for ILR in March 2016, as I am completing my Continuous 5 years duration.

Can I apply ILR for my wife too at the same ?? because by that time she also completing 5 continous year in 3 different visas.

If she is not eligible for ILR, which visa she need to apply and also can she apply on same day when i am applying ILR long with me. can we submit to same case worker?

Both my visa and my wife visa is going to expired on 6th April 2016.

Pleases suggest.

No, she needs 5 years residence as your dependent. Student visa and PSW does not lead to ILR based on 5 years residence. It is only counted if applying on the basis of 10 years long residence.
If she is not eligible for ILR, which visa she need to apply and also can she apply on same day when i am applying ILR long with me. can we submit to same case worker?
She can continue to extend her Tier 1 Dependent visa until she meets the requirements for ILR. She can apply same day but she needs a separate appointment, roughly 2 hours after yours, if you are applying in person.

one more question is there any ILR dependent visa, because if i fill Tier1 Dependent visa my tier-1 visa is going to end on 7/04/2016 and also i will be switched over to ILR.

Is there any ILR dependent visa form?

The rules allow her to stay on the same visa and extend until she qualifies for ILR even if you already have ILR through Tier 1 G. She will likely only need one extension on Tier 1 G Dependent to reach 5 years residence and is the quickest way to ILR for her.

If she switches to FLR(M) - ILR dependent - this will reset her clock to zero again and she starts from scratch and a new 5 year period (2 x 2.5 year visas) towards ILR.

Hi Thank you for replying me back, Please can you give more details if my visa expried on 7 april 2016 (T1- General) if i am applying for ILR visa and on same day if i apply for T1_or_5_Dependant, there do not ask that my Tier-1 visa is going to expired on 7 April 2016 how can i apply for T1_or_5_Dependant?

Thank you for sending the link and materials for my case study.

I need one more help for TIer 1 Gen Dependant visa do i need to fill B10. Please provide your Immigration Health Surcharge reference number (IHS) as i am going to ILR visa and my wife she is going for TIer 1 Gen Dependant visa.

My visa is expired on 7/04/2016 and same day even my wife visa is expiring because of this i am bit confused to fill B10. Please provide your Immigration Health Surcharge reference number (IHS).

One more thing can we pay Health Surcharge if i take day appointment and fill in front of case study.

She has to pay the health surcharge before submitting her application.

And no, you cannot pay it and fill in at the same day appointment. You will not be able to progress if you have not paid the surcharge.

I tried to calculate the Immigration Health Surcharge using the following link:

On this page, for a Tier 1(General) PBS dependent applicant residing in uk which option is relevant ? Is it 1) Applying alone or 2) Applying to join somebody (a main applicant) in the UK. Can you please suggest?

Hi Thank you for helping in filling IHS.

Please can you advice me in filling ILR visa,

1. For Residence proof- is fine if i give only mortgage letter .

2. Do I need to give all 5 years P60 or last year P60 is it fine.

3. Do i need to give address proof for all 5 years ?

4. SA302 do i need to give all 5 years all last year SA302 is fine.

5. Can i submitted my ILR visa and tier-1 dependent visa to same case worker, if so do i need to explain him any thing.

3. You need to list addresses in the form as asked.

4. Take all with you to be safe, you might be asked for them as HO is making detailed and stringent checks now on Tier 1 G migrants tax history.

5. No. You need to book two separate appointments as they are two separate/different categories and two separate forms. Tier 1 Dep a couple of hours after your appointment.

But if i submitted my passport and Biometric for ILR what i need to submit for Tier 1 Dep this is my confusion.

You need 2 years cohabitation proof and as you will both be at the premium centre, the caseworker dealing with your wife's application can check with the caseworker dealing with your application if you have not had a decision.

Make copies of the documents your wife needs and you can explain that the originals are with your ILR app.

If that is within 28 days of meeting the 5 year requirement then yes.

You need two years cohabitation documents for your spouse, either in joint names or individual names, spread evenly over the previous 2 years. Mortgage letter can be used yes.
