Clarification required in filling Form MN1

Post by jamuk » Mon Feb 20, 2017 7:54 pm

Hi,

I am filling Form MN1 for My child born In India. Both parents are Indian nationality with ILR.

We need the help to clarify the following

Section 1 - Personal Information
1.1 - Please indicate the section of the British nationality Act 1981 under which you would like the application considered
Question:
- What should be filled in?

Section 3 - Parents residence in the UK or the British overseas territories, where applicable
Question:
- do we need to fill section 3 in my case?
- If yes, please let me know which subsections need to be completed.

Section 8 - Declaration
- 8.9 - For those applying under section 3(2) of the British nationality Act 1981, I confirm that i am aware of the benefits of registration under section 3(5) of the 1981 Act but still wish to proceed under section 3(2)
Question:
- Do we need to tick this?

Thanks
Jamuk

That is for Children of British Citizens by descent (i.e. can't automatically pass on citizenship to children if they themselves were born outside the UK/Territories).

Form MN1 guide: https://www.gov.uk/government/uploads/s ... y_2017.pdf

Section three of the form which asks for parents residence in the UK (i.e. questions 3.1 - 3.12) is only for British Citizen parent/s

Are the parents also applying for naturalisation at the same time as the child's registration?

Ignore this section, not relevant to you.
Section 8 - Declaration

Not relevant as you are not applying under 3(2) or 3(5)

Surname different in passport and BRP

Post by jamuk » Tue Feb 21, 2017 1:50 pm

Hi,
I have my ILR received on 23/11/2013 and my BRP card and my passport had my father's name as surname.

I have now changed my surname in my passport from father name to husband name on 2/2/2017.
I am going to apply for British nationality in beginning of March 2017.

I have changed my surname to my husband name in all the key documents like passport, License, Bank, NI, Electoral Register etc.

I have not changed my surname name in my BRP, I am going for my naturalisation shortly
- do I need to change my BRP surname before I go for naturalization?
- if I don't change will this have an impact on my naturalization process?

Please advice
Thanks
