ILR - Can me & my partner apply together?

I will be applying for ILR in Feb 2010 having been on a work permit for 5 years by then. My partner (we are getting married in October this year) is on HSMP and has been on it for only a few months. Can I apply for ILR with my partner? Or will him changing to a spouse visa help so he can apply for ILR with me on my application?

Any help would be highly appreciated.

He should initially apply for a work permit dependant entry clearance. See also WP+spouse dependent-->ILR.

Vinnie so should he switch from his HSMP to being my dependent? Will he then be able to apply for ILR with me in Feb 2010? We will only have been married 5 months by then.. is that ok? He has been on his HSMP only for a few months.

There appears to be no minimum residential period required for work permit dependants (196E).
